PickFresh (“we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our mobile application and website (collectively, the “Platform”).

Who We Are

Our website address is: http://pickfresh.net. PickFresh is a marketplace platform connecting local sellers of fresh produce with buyers through our mobile application and website.

Information We Collect

Information You Provide Directly

When you create an account or use our Platform, you may provide:

  • Account Information: Email address, password, name, and authentication credentials (when using Google or Apple OAuth)
  • Profile Information: Optional profile details, contact preferences (email, phone number visibility settings)
  • Seller Information: If you become a seller, you provide pickup locations, contact information, and product details
  • Product Listings: Product descriptions, photos, pricing, availability, and pickup information
  • Location Data: Addresses you provide for pickup locations, including geocoding data (latitude/longitude)
  • Communications: Messages and interactions with other users or our support team

Information Collected Automatically

When you use the Platform, we automatically collect:

  • Device Information: Device type, operating system, unique device identifiers, mobile network information
  • Usage Data: Pages viewed, features used, search queries, products favorited, time spent on the Platform
  • Log Data: IP address, browser type, access times, pages viewed before and after using the Platform
  • Location Information: With your permission, we may collect precise location data through GPS, WiFi, or cellular network information to show you nearby products

Information from Third Parties

We receive information from:

  • Authentication Providers: When you sign in with Google or Apple, we receive basic profile information they share with us (name, email, profile picture)
  • Google Places API: Address data and geocoding information when you enter pickup locations
  • Clerk (Authentication Service): Authentication tokens and user management data
  • Stripe (Payment Processor): Transaction details (such as payment status, amount, currency, and the last four digits of your card), Stripe customer and connected-account identifiers, and payout information. PickFresh does not receive or store your full payment card number, CVV, or full bank account details — those are handled directly by Stripe.

How We Use Your Information

We use the information we collect to:

  • Provide and maintain the Platform: Create and manage your account, enable listings, facilitate connections between buyers and sellers
  • Personalize your experience: Show you relevant products based on your location and preferences, remember your favorites
  • Enable marketplace features: Display seller contact information (based on their preferences), show product locations on maps, facilitate search and discovery
  • Communicate with you: Send important updates about your account, respond to your inquiries, notify you of Platform changes
  • Improve our Platform: Analyze usage patterns, identify and fix technical issues, develop new features
  • Ensure safety and security: Detect and prevent fraud, abuse, and illegal activity, enforce our Terms of Service
  • Comply with legal obligations: Respond to legal requests, protect our rights and the rights of others

How We Share Your Information

With Other Users

To enable the marketplace:

  • Public Profile Information: Your public profile, product listings, and any information you choose to make public are visible to other users
  • Seller Contact Information: If you are a seller, buyers can see the contact information you choose to display (email and/or phone number based on your contact preferences)
  • Pickup Locations: Product pickup locations you list are visible to potential buyers

With Service Providers

We share information with trusted third-party service providers who help us operate the Platform:

  • Clerk: Authentication and user management
  • Convex: Real-time database and backend infrastructure
  • Stripe: Payment processing for buyer purchases and payouts to sellers. When you pay or receive payouts on PickFresh, your payment information is collected and stored directly by Stripe under Stripe’s Privacy Policy. PickFresh shares with Stripe only the information needed to process your transactions and payouts.
  • Cloud Storage Providers: Storing product photos and images
  • Google Maps/Places: Location services, geocoding, and map display
  • Apple Maps: Map display on iOS devices
  • Expo/React Native Services: Mobile app infrastructure and development tools

These service providers are contractually obligated to protect your information and only use it to provide services to us.

We may disclose your information if required by law or if we believe in good faith that such disclosure is necessary to:

  • Comply with legal obligations, court orders, or government requests
  • Protect and defend our rights or property
  • Prevent or investigate possible wrongdoing
  • Protect the safety of users or the public

Business Transfers

If PickFresh is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control of your personal information.

SMS and Text Messaging

This section describes how we collect, use, and protect the information you provide when you opt in to receive SMS (text message) notifications from PickFresh. It applies in addition to the other sections of this Privacy Policy.

What Messages We Send

When you opt in, PickFresh sends transactional SMS notifications related to your use of the Platform, including:

  • New order alerts to sellers when a buyer places an order
  • Order confirmations and status updates to buyers
  • Payment confirmations when a payment is received
  • New message notifications when a buyer and seller exchange messages about an order
  • Account and security notifications

We do not send marketing or promotional SMS.

How You Opt In

SMS consent is collected inside the PickFresh mobile application. During seller onboarding, you are asked to provide a phone number, and you must separately and explicitly check an unchecked consent box to enable SMS notifications. Consent is never a condition of creating an account, listing produce, or otherwise using the Platform. See the SMS Opt-In Program Details page for screenshots of each opt-in path.

Mobile Information Sharing — Our Commitment

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All opt-in requests and consent information are not shared with any third parties. We share your phone number only with the messaging infrastructure providers that help us deliver the messages you asked to receive (for example, our SMS delivery partner) and only for the purpose of delivering those messages.

Message Frequency

Message frequency varies based on your account activity. For example, sellers typically receive one message per buyer action (such as a new order or new message). We do not send recurring promotional blasts.

Message and Data Rates

Message and data rates may apply. Your wireless carrier, not PickFresh, sets these rates, and they are not our responsibility.

How to Opt Out

You may opt out of SMS notifications at any time by:

  • Replying STOP to any SMS you receive from PickFresh. This will end SMS notifications to that number.
  • Toggling SMS notifications off within the PickFresh app under Profile → Preferences (where available).

After you opt out, you may continue to receive non-SMS communications (such as in-app push notifications and email) unless you also disable those channels.

  • Reply HELP to any SMS you receive from PickFresh to receive help information.

Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages.

Your Mobile Data Rights

You have the same access, correction, and deletion rights over the mobile phone number and SMS-related data we hold about you as you do for the rest of your personal information. See the Your Privacy Rights section above.

Media and Image Uploads

If you upload images to the Platform (such as product photos), you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the Platform can potentially download and extract any location data from images.

Product photos are stored securely in cloud storage and are associated with your listings. Both the public URL and internal storage ID are maintained for each image.

Cookies and Tracking Technologies

Authentication Cookies

When you log in to the Platform, we set authentication cookies to maintain your session. These cookies:

  • Keep you logged in as you navigate the Platform
  • Store your authentication tokens securely
  • Remember your preferences and settings
  • Expire when you log out or after a period of inactivity

Mobile App Data Storage

Our mobile app stores certain data locally on your device to improve performance and enable offline functionality:

  • Cached product listings for faster loading
  • Your favorite products list
  • Recent search queries
  • App preferences and settings

Analytics

We use analytics tools to understand how users interact with the Platform. These tools may collect information such as how often you use the app, events that occur within the app, and performance data.

Data Retention

We retain your information for as long as necessary to provide the Platform and fulfill the purposes outlined in this Privacy Policy:

  • Account Information: Retained while your account is active and for a reasonable period after deletion for legal compliance and fraud prevention
  • Product Listings: Retained while active and for a limited time after removal for platform integrity
  • Transaction History: Viewable data of your interactions (favorited products, search history) retained while your account is active
  • Communications: Retained as necessary for customer support and legal compliance

When you delete your account, we will delete or anonymize your personal information within a reasonable timeframe, except where we must retain it for legal, regulatory, or security purposes.

Depending on your location, you may have certain rights regarding your personal information:

Access and Portability

You can request a copy of the personal information we hold about you. You can view and update most of your information directly through your account settings.

Correction

You can update your account information, profile details, and contact preferences at any time through the Platform’s settings.

Deletion

You can request deletion of your account and associated personal information. Note that we may retain certain information as required for legal, regulatory, or legitimate business purposes.

Opt-Out

You can control:

  • Which contact information is visible to other users (email, phone number)
  • Location services through your device settings
  • Push notifications through your device settings
  • Marketing communications (if applicable)

California Privacy Rights

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect, the right to delete your information, and the right to opt-out of the sale of your information (note: we do not sell personal information).

Data Security

We implement appropriate technical and organizational measures to protect your personal information, including:

  • Encryption of data in transit and at rest
  • Secure authentication through Clerk with support for OAuth providers
  • Regular security assessments and updates
  • Access controls limiting who can access personal information
  • Secure cloud infrastructure with leading providers

However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

Children’s Privacy

The Platform is not intended for users under 18 years of age. We do not knowingly collect personal information from children under 18. If you believe we have collected information from a child under 18, please contact us immediately so we can delete it.

International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence. These countries may have data protection laws that differ from your jurisdiction. By using the Platform, you consent to the transfer of your information to our facilities and service providers globally.

The Platform integrates with third-party services (Google Maps, Apple Maps, Stripe, OAuth providers). These third parties have their own privacy policies governing their collection and use of your information. We are not responsible for the privacy practices of these third parties.

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on this page and updating the “Last Updated” date. We encourage you to review this Privacy Policy periodically.
